Abandonment of Easement: Muskrat Lake, Westmeath

The Council of the Township of Whitewater Region approved an abandonment of an easement over Part 6 on property PT LT 8, CON 5 E of Muskrat Lake, Westmeath, Parts 5 & 6.

Roads Department Manager Lane Cleroux reported on the abandonment of an easement in Westmeath

“These three properties that are listed were a severance from Part 13 back in 2012.” he said. “Part of the conditions were to move the drainage ditch to allow for that part 6 to be a property. At the time of the creation of the properties, the intent was two parts. One was for drainage – there was a pond in part is . I think the intent of the easement was to limit any building until the part will done. It came to our attention when the owners were selling the property- a lawyer came to us with that. This will remove that easement.

He said that part one, as well as the easement over parts 3 and 4 will have to be removed in the future.

“So you’re saying now we don’t need that as a drainage?” Councillor Jackson asked.

“Part of the severancee they actually moved the drainage ditch to part 5. We will still have an easement over part 5.” Manager Cleroux said.

“As long as we’re not losing the drainage.” Councillor Jackson said.

“This will remove part 6, which is not the drainage ditch.” Manager Cleroux said.

The motion was carried.
