PEMBROKE — Two court cases dealing with Whitewater Region Township will return to the courts next month.
Garry Burns and John Felix Cull, were each charged with failure to buy a dog tag in 2013. The two men have been in court 14 times previous to this past Monday regarding this case.
Monday morning, Donna Burns stood in for her husband who was unable to attend court.
Paralegal Jeff Bogaerts spoke on their behalf and he advised they are aware he is not a lawyer.
Justice of the Peace Nancy Mitchell heard the case. She said there will be a judicial pre-trial and on July 20, the case will be back in court “to be spoken to.”
JP Mitchell said, “Both (lawyers) need to set a judicial pre-trial for the Garry Burns’ matter,” she said.
When the case comes back for trial, JP Mitchell said she nor JP Barry Moran, who recused himself during the last court date, will not be the presiding justice of the peace.
While it was hoped there would be a court date set, JP Mitchell said there is new protocol set down by the new regional senior officer of the justice of the peace, Linda Leblanc.
“She has lots of scheduling experience and is scheduling everything for the east region,” JP Mitchell said.
As for Mr. Cull’s case, Mr. Bogaerts was hopeful the two could be held at the same time since they were both charged for the same offence.
JP Mitchell said that would be fine and asked the clerk to indicate on the paperwork the cases are co-related.
She again reiterated that Ms. Leblanc, the regional senior officer of the Justice of the Peace, will review the information.
Cobden businessman Doug Shields, owner of The Chip Pit, was also in court Monday morning.
A court date of Tuesday, Oct. 27 at 10 a.m. was set for his charge, which is related to an inspection order from the Whitewater Region Fire Department he refused to act upon.
